A Death in the Sunshine State

Love and Death in the Sunshine State: The Story of a Crime by Cutter Wood (Algonquin Books of Chapel Hill, $26.99, 225 pages)

This book arrived at the right time.  I had just finished reading a true crime book and found it to be sadly disappointing.  The writer put down all the facts about a triple murderer and his trial but seemingly without context.  When one sentence follows another in this manner – without drama, suspense or the seeming presence of actual people, it’s far less than engaging.

Cutter Wood’s book, Love and Death in the Sunshine State, is like the antidote to the typical true crime story.  Wood, an MFA graduate in nonfiction from the University of Iowa, touched base with all of the principals about a murder that he felt somewhat connected with.  You see, after graduating from Brown he felt directionless – like Benjamin in The Graduate, so he spent months at a secluded hotel in Florida.  The woman who ran the hotel with her husband later disappeared and Wood was determined to get to the bottom of the mystery.

Wood knew some of the principals involved and was also given access to law enforcement officials and the man suspected of killing the missing woman.  But once the crime was solved, Wood felt that little was resolved.  The facts did not seem to add up to a whole, complete story.  Therefore, he elected to pursue a unique option.

Instead of writing a dry nonfiction account of the crime, Wood decided to write a fictional version of a relationship between a former criminal and a successful married businesswoman whose lives intersected.  It’s a story of an unlikely attraction, a loving relationship, and a tragic ending.  Wood never attempts to explain the crime or the murderer’s mind, but paints the events – both real and imaginary – as something that was fated to occur.

As Wood is free to explore events and scenarios that may or may not have played out, he develops a story that feels fully real.  This is not Law and Order – a stereotypical version of crime and justice, nor is it a fly-over account of a crime developed for a one hour cable TV network show.  It is a story of two imperfect people who were drawn to each other for all of the wrong reasons.

By leaving out some of the seemingly critical crime details and facts that would be highlighted in the standard true crime book sold in an airport gift shop, Wood proves again that less is more.  His “story of a crime” focuses on the small yet significant aspects of the lives of two people.  In doing so, he brings the individuals to life and causes us to mourn – in a quiet, dignified way, the loss of one of them.

It’s a sad, tough story but Cutter Wood takes the reader to the heart of the matter.  His is a respectful approach to human imperfection and frailty.

I look forward to reading Wood’s future works.

Everyday I Write the Book

“Things in life are both big and small in equal proportion.”   The New York Chronicle

“Suspension of disbelief” is a phrase that is often used by book reviewers, and when it is, it’s usually not good news.   When someone states that they could not suspend their disbelief, it means that the story they were reading (or the film they were watching) never felt real.   I don’t know about others, but when I begin to read a fictional work that does not feel real, I get a mental picture of the writer in question at a computer struggling to figure out the next word, sentence, paragraph, chapter…  The choppy feeling of a not-quite-true creation overwhelms the potentially positive experience of encountering a new world.

I suspect that it’s hardest for someone to suspend their disbelief when they’re reading a novel about the very world that they inhabit.   Let’s say, for example, that I was to write a novel about a major, fictional rock star.   I think that actual rock musicians would be the toughest critics as they likely would find the story to be too “over-the-top” (not every rock band tears up hotel rooms), or find that it failed to reflect the tedium of life on the road.   Most likely, a musician would want to find a story that he or she could relate to – one that would equally balance the drama and boring aspects of the professional music maker’s life.   And, he or she would want to read a story in which – as in life – what comes next is never predictable.

My experience of having worked in many aspects of the criminal justice system may explain why it is usually the hardest for me to locate the supposed realism in courtroom dramas and crime novels.   I usually find fault from two different perspectives.   Firstly, these novels often start off with plot lines that are far too tricky; too many authors seem to have been influenced by the shenanigans of John Grisham, who seems to need overly complicated and unrealistic stories to grab the reader’s interest.   The same is true for the too-clever endings inspired by another successful writer, Scott Turow.

The plot for these books often centers around something that’s not going to happen – like the killing of a major U.S. senator’s wife (at a time when the senator just happens to be having an affair).   But most of what goes on in the criminal justice system is not so dramatic.   If I were to attempt to write a book about the average case, it might involve a young man who has experienced numerous small scrapes with the law before some friends encourage him to ride along with them on a lark.   It’s during this ride that someone gets killed and our young man – being the only one with a criminal history – takes the fall.   Yes, I know, many publishers would think this is relatively dull stuff, but as John Lennon used to say, “…that’s reality.”

The second issue I have with these novels is that despite the dramatic plots, the characters often seem to be cut from cardboard.   They’re pretty lifeless compared to the often big personalities that inhabit the criminal justice system.   There are public prosecutors who wear $1,000 suits and drive cars meant for millionaires.   There are prosecutors and public defenders who don’t necessarily love their co-workers, and some prosecutors and public defenders have been known to have a drink together.   Some deputy district attorneys don’t always get along with law enforcement officers.   In other words, life in the halls of justice and the courtrooms is a bit messier than it’s portrayed in the latest crime novel.   It’s also certainly not as “clean” as a typical episode of Law and Order.

I think what’s forgotten is that these are real human beings, with great strengths and corresponding flaws; and they live and work in an imperfect world, a somewhat less than perfect criminal justice system.

What’s the moral of this article?   Simply that I’d love to see criminal justice system-based fiction that tones down the overly dramatic plots while raising the volume on the unique individuals who make their living within the law.   Is there a writer who gets the characters right?   Yes, I’m glad you asked…  Interestingly, former prosecutor Marcia Clark (Guilt By Degrees, Guilt By Association) seems to portray some very realistic figures in her novels, although she cloaks them in the guise of sarcasm and humor.   Still, it’s a start and want-to-be crime novelists would do well to read her work, and/or spend some actual time with the prosecutors, public defenders, defense attorneys, and policemen and policewomen who work very tough jobs that are so very rarely accurately portrayed.

Think of a Number: A Novel by John Verdon (Broadway, $14.00, 448 pages)

“On the one hand, there was the logic of the law, the science of criminology, the process of adjudication.   On the other, there was pain, murderous rage, death.”

John Verdon, a former advertising firm executive in Manhattan, has produced a brilliant debut novel that offers a cynical and skeptical look at today’s criminal justice system.   In Verdon’s words, “…the justice system is a cage that can no more keep the devil contained than a weather vane can stop the wind.”   If one read this novel with no knowledge of the writer’s background, one would guess that he’s a retired policeman or prosecutor.   It is quite hard to believe that Verdon has no personal knowledge of the bleak and challenging world that he writes about so expertly in this work.

In Think of a Number, retired detective David Gurney and his wife Madeleine live in the hills of Delaware County.   She is the smarter of the tow, although he is considered to be the most brilliant crime solver who ever worked for the New York City Police Department.   Gurney is so legendary that his adult son says to him, “Mass murderers don’t have a chance against you.   You’re like Batman.”

But Gurney may have met his match when he’s asked by the county district attorney to serve as a special investigator on a serial murder case.   The killer seems to do the impossible.   First, he sends his intended victim a message asking him to think of a number, any number at all.   Once they think of the number they are instructed to open a sealed envelope left in their home; this envelope contains a piece of paper with the very number they thought of written down in ink.   As if this is not amazing and frightening enough, the killer subsequently calls his intended victim and asks him to whisper another number into the phone.   After he does so, he is instructed to go to the mailbox.   There he retrieves a sealed envelope with the very number he just whispered typed on a page that was in the envelope.

Gurney is fortunate in that he’s very ably assisted by Madeleine, the spouse who often sees the very things he’s missed.   But no one can figure out how the serial murderer performs his tricks with numbers, or how to capture him.   In order to solve the puzzles, Gurney is going to have to consider making himself a target of the killer.   Gurney’s logic and research tells him that the serial killer is a control freak, one who kills victims in different states (like Ted Bundy) but operates according to a strict if twisted plan.

Gurney must come up with a theory as to what connects these male victims – who seem to have no apparent connection – in order to figure out why they were killed.   Once he does so, he begins to formulate a plan that will put him face to face with a madman genius.   (The reader, luckily, will not even come close to predicting what’s ahead.)

Think of a Number is a fast-moving, cinematic-style suspense thriller.   It’s easy to see this novel being made into a film.   At heart, it’s an old-fashioned morality play in which a retired white-hat wearing man must come out of retirement to battle with an all too clever mean-hearted outlaw.   Detective Gurney engages the enemy – a modern devil – while understanding that in the gritty field of criminal justice there are no final victories.

This is an impressively written and addictive story – especially so, as it’s a debut novel.   One is advised to refrain from starting it without having cleared a large block of hours on your schedule; otherwise, hours of sleep will be lost.   Once finished, you will no doubt begin to look forward to Mr. Verdon’s next satisfying thriller.

This is the Day

Defending Jacob: A Novel by William Landay (Delacorte Press, $26.00, 432 pages)

William Landay’s courtroom novel, Defending Jacob, is interesting and engaging, but is it – as per the hype – this year’s version of Presumed Innocent?   Sorry, but no, it’s not.   This is one of those novels that comes down to the fake ending, where there are usually one or two twists that the reader didn’t anticipate or see coming.   But, this time around, the reader has to deal with three feints and it all seems a bit much.   The author is a graduate of the Boston College of Law, and I presume that at some point he heard an instructor state that, “The game is not worth the candle.”   That’s a law professor’s way of saying that a lawyer’s or judge’s argument is far too clever to be convincing; which is precisely the way I felt about Defending Jacob.

This is a story about a Chief Assistant District Attorney who takes on a case involving the stabbing death of a 14-year-old student at his own son’s high school.   It turns out his son is the prime suspect and, before you can sing a song by the 80s band The The, he’s banished from the office.   The next thing he knows, he’s the second chair to a criminal defense attorney who’s defending his son on a charge of murder.

“After a thousand years or so of refining the process, judges and lawyers are no more able to say what is true than a dozen knuckleheads selected at random off the street.”

“…it was a little late in the day to be switching sides.   I was not sure I could bring myself to defend the same scumbags I had spent a lifetime locking up.”

What Landay does well – quite well – is to express in a firm and gruff voice his doubts (as a former prosecutor) about the workings of the American criminal justice system.   But his protagonist Andy Barber comes off sounding less like a lawyer and more like one of those grizzled former cops who becomes a hard-shoe Private Investigator.   There were times, in fact, when I felt the story – set in 2007 – turn from color to black and white.   It sometimes seemed that, except for references to personal computers, I was reading something set in the 1950s rather than in near-current times.

Defending Jacob has its moments, but a better read in this genre is Tell No Lies: A Novel by Julie Compton, a taut courtroom drama that comes replete with “a surprise ending.”   That’s one surprise ending, not two or three.   Because when it comes to Scott Turow-style surprise endings, less is more.

Restless Souls: The Sharon Tate Family’s Account of Stardom, the Manson Murders, and a Crusade for Justice by Alisa Statman with Brie Tate (It Books, $26.99, 380 pages)

“Pardoning is God’s domain…  I forgave Sharon’s killers through His grace.   But, within, the laws of man, this forgiveness didn’t lessen the killer’s culpability or diminish my ambition to keep them in prison.”

This is an engaging and sometimes moving (and sometimes overdone) account of the life of a family that was terribly affected and afflicted by a brutal crime – the murder of Sharon Tate.   There are two names listed as authors, one being the domestic partner of Tate’s younger sister and the other her niece.   But, in fact, the book was written by four parties since it incorporates the words of Sharon Tate’s mother and father; both of whom intended to write their own memoirs.   And, to some extent, it was also written by Vincent Bugliosi as it borrows generously from his bestselling book Helter Skelter.

The one major flaw with this nonfiction work is that it was likely released at the exact wrong time.   I may not be correct (and I am not taking a side on this issue), but the political winds seem to be blowing in the direction of a moderately to dramatically less “tough on crime” approach than was exercised in the past.   This, at the least, appears to be true in California.

Restless Souls at times reads like a legal and political brief for locking them up and throwing away the key.   This is understandable as Doris Tate, Sharon’s mother, was a prominent figure in the victim’s rights movement in California and throughout the country a few decades ago.   She was recognized as one of the Thousand Points of Light by the first President Bush and worked very closely with California governors George Deukmejian and Pete Wilson.   Had this book been released in the period between 1980 and 1991, it would likely have drawn a great deal more attention that it’s going to get today.

A major part of the “Crusade for Justice” addressed in this account were the attempts by the Tate family to ensure that none of the Manson Family members were released from state prison.   These efforts were successful (Susan Atkins died in her cell); a fact which, ironically, takes away the weight and suspense of the telling.

Probably the most interesting of the four family member’s accounts is the one written by Sharon’s father P. J. who was in court during the Manson Family trials.   P. J.’s version of the courtroom dramas is fascinating, yet it takes a back seat to Bugliosi’s chilling version (Helter Skelter perhaps being the second best nonfiction account of a crime ever written, next to Truman Capote’s In Cold Blood).   This is something that’s apparent to Statman and Tate since a surprisingly – almost shockingly – lengthy excerpt of Helter Skelter is used here to describe the murders of Sharon Tate, Jay Sebring and the others at the home on Cielo Drive above Beverly Hills.

Astoundingly, Statman goes on to claim that Bugliosi’s book “was missing emotion” for the crime victims, something that could hardly seem to be less true based on the prosecutor’s writings and his work in court.   It’s the authors’ emotions, on full display, that make otherwise cold accounts, Helter Skelter, In Cold Blood and Joseph Wambaugh’s The Onion Field, so very stunning and moving.   These three books, once read are never, ever forgotten.

“Parents are covictims, and many of them get worse when the legal process is finished…  Now they begin to pine for their (lost) child in earnest…  They have to reconstruct their whole belief system because their assumptions about the decency of humanity, the security of social order, and justice are all shattered.”

Restless Souls serves as a needed reminder of how crime victims are often twice brutalized in our society and in the criminal justice system (having to deal with both a crime and its true aftermath in human terms), but I suspect it will mostly be read by criminal justice students as an historical account and not much more.

Texas Tough: The Rise of America’s Prison Empire by Robert Perkinson (Picador; $20.00; 496 pages)

“Hardly light reading…  a slog through a muddy field.”

It’s doubtful that anyone would wish to take the position that modern American prisons serve as the perfect example of rehabilitative environments.   Yet Professor Robert Perkinson takes approximately 500 pages to argue the case that they are not the best representation of a “forgiving society.”   That’s fine but this reviewer wishes that at least half of this large tome had dealt with solutions rather than simple issue spotting.   Finding problems is the easy part, finding solutions – applying innovative social engineering – is the tough part and is missing from this quasi-legal brief.

Texas Tough is highly documented with source materials and yet academic knowledge is not the same as practical experience.   At one point in his Conclusion, for example, Parkinson disparages “high-tech uberprisons like Pelican Bay in California,” as not being very friendly (prisons like this are “regimented lockups” in his view).   I saw no indication in the Notes that Mr. Perkinson has ever visited Pelican Bay (as I have); this is an end-of-the-line facility for the most violent of hard-core offenders.   It is not meant to serve as either a Club Fed or a cozy community college.

What would Mr. Perkinson do as the administrator of such a facility?   (Asked but not answered.)

One of the most interesting aspects of this book (and the first half is much harder reading than the second half due to some highly obtuse language) is the application of The Law of Unintended Consequences, popularized by the sociologist Robert K. Merton.   This principle is often referenced in law schools as litigation and legislation-based reforms may produce results that surprise their sponsors.   Due to court-ordered reforms in the state of Texas, for example, the author notes that inmates are now “as plagued by tedium as toil.”   Their death rates are also much lower.   These two points don’t seem to support his case very well.

The professor also spends a great portion of this work arguing that northern prisons have become more punitive (and “southern”), while southern prisons have become more “northern” and less harsh.   Perkinson ties this to race but it seems more than a bit tenuous.   Let’s just say that it may remain an interesting issue for further research for sociologists.  (Just a thought: Why didn’t Perkinson compare west coast prisons to east coast ones?)

If one has never read a book about the U. S. correctional system, then this might make for an interesting, if sometimes blatantly overdone, introduction to the subject.   It is hardly light reading.   In fact, it is sometimes a slog through a muddy field.

This reviewer is hopeful that someone follows up on this survey work with a constructive and solution-based approach to what Professor Perkinson somewhat dramatically labels as “America’s Prison Empire.”

Nowhere to Run

The Insider by Reece Hirsch (Berkley Books; $7.99; 330 pages)

Reece Hirsch employs a confident narrator’s voice to draw in the reader in this, his debut mystery novel.   What seems to be a nice change of pace with opening scenes devoid of terror, soon shifts as a startling event culminates in a gruesome death.

The main character is Will Connelly, an aspiring fourth-year associate with a prestigious San Francisco law firm.   Will’s gullibility may be alarming to the reader.   He has a very promising future with the firm; however, for a fellow being considered for an equity partnership, Will’s short on street smarts.   Perhaps that failing can be attributed to four 2,400 plus billable hour years?   His dedication to work has left him without a steady girlfriend.   Will’s decision to go out and, on a whim, fall into a barroom pickup may just be a way to let off steam.   Questionable actions like this create not-so-subtle plot turns and complications.

The shifting story tempo continues as two Russian gangster-wannabes and the negotiations for a super-big Silicone Valley acquisition vie for the reader’s attention.   The notions of lurking threats, pain and criminal charges keep Will off-balance for the duration of the story.

Hirsch makes the city of San Francisco serve as the backdrop for the book’s action.   A trip to Silicone Valley and an outing on the bay round out the list of locations visited.   There is rarely a moment of downtime as the plot ensnares more characters.   Ironically, the Russian gangsters and the attorneys are portrayed as complex folks who want to climb the ladder of success and enjoy the fruits of their labors.

“With his immaculate gray suit and perfectly coiffed salt-and-pepper hair, he looked as if he had been genetically engineered to make board presentations.”

The Insider joins a group of this reviewer’s favorite novels that make San Francisco their home.   The other two books are Death in North Beach by Ronald Tierney and Jessica Z by Shawn Klomparens.

This book is highly recommended as an entertaining Grisham-like look at the pressures of corporate law practice.   Let’s hope most mergers and acquisitions are not as painful!

Reeling in the Years

I’d Know You Anywhere: A Novel by Laura Lippman (William Morrow)

There are writers who, like certain songwriters, can be admired more than they can be enjoyed.   In the field of songwriting, the team of Walter Becker and Donald Fagen – collectively known as Steely Dan – has often been praised for their tunes steeped in irony even if their songs are more clever (more intellectual) than charmingly fun.   I kept thinking of Steely Dan and, especially, the song “Reeling in the Years” as I read this latest novel from the prolific writer Laura Lippman.

Lippman’s skills are to be recognized as she persuades a reader to turn over 370 pages of a story that does not amount to a lot.   There are two protagonists.   There’s the now-38-year-old Eliza Benedict, who was kidnapped and raped and held for 39 days by Walter Bowman, who sits on death row in Virginia awaiting his execution.   Bowman is a spree-killer convicted of two murders in two states, but he may have killed as many as eight young girls.   Why he didn’t kill Eliza (then known as Elizabeth) when she was 15 is supposed to be a question that puzzles everyone.   Except that Bowman was captured after a simple traffic stop.   The notion that he might have killed Eliza had he not been taken into custody when he was seems to elude everyone here.

Although Lippman gives her readers a lot of twists and turns and feints, there’s not much drama in this crime drama, and not much thrill in this psychological thriller.   It is interesting enough, but just enough.

Eliza never comes to life, especially as she displays no anger against Bowman.   When Bowman contacts her just weeks before his scheduled death, she becomes his strangely witting accomplice without much effort.   Eliza is a character that’s simply not present in her own life:  “Her time with Walter – it existed in some odd space in her brain, which was neither memory or not memory.   It was like a story she knew about someone else.”

A character in the book, a hack writer who wrote a “fact crime” book about Bowman, complains that he’s just simply not as interesting a criminal as, say, Ted Bundy.   That’s certainly the case as we never come to know what it is that made Bowman a killer, nor how it is that this man with a said-to-be just average IQ is suddenly cunning enough to use his victim Eliza in a last-minute plan to gain his freedom.   Something key is missing here as the author admits:  “(Her) mother had long believed that Walter had experienced something particularly wounding in his youth.”

Since neither of the two characters ever becomes fully realized, it’s hard to care about whether Eliza will, in the end, forgive Walter and/or help him avoid execution.   The reader will, however, wonder why this now happily married woman is willing to risk her contented life for someone who harmed her.   Since Eliza does not know herself, she certainly will never come to know or constructively forgive her former captor.

A significant flaw in this crime drama is that the interactions with participants in the criminal justice system feel like flyovers, neither grounded nor concrete.   The lawyers seem to be portrayed more as actors (attention being given to how they look and dress) than as advisors.

In the end, this reader admires Lippman’s skills, her persistence and her success.   However, reading this novel was a bit like trying to listen to that Steely Dan song “Reeling in the Years” as it plays in another room, down the hall, too far removed to be heard clearly.
